RETAIL TERMS AND CONDITIONS
Use of this website is subject to the following terms and conditions:
* Orders are accepted on the condition that prices to be charged are those ruling at the date of dispatch.
Whilst every endeavour will be made to deliver goods on the date requested, this does not impose any
legal obligation on ChocoPatiss to meet such delivery date.
* ChocoPatiss reserves the right to withdraw any item without notice.
* Faulty goods should be returned direct to ChocoPatiss within 7 days of receipt. Upon return to ChocoPatiss
the goods will be inspected and if found to be faulty, the goods will be replaced or credited at the net price
paid. Liability for goods damaged in transit will not be accepted unless notification is made to the sales
department of ChocoPatiss within 5 working days of delivery. For products that are provided with a hygiene
seal, the return will only be accepted if the seal is intact.
* Due to hygiene regulations it is not possible to return the chocolate moulds.
* Liability for goods shortages will not be accepted unless notification is made to the sales department of
ChocoPatiss within 5 working days of delivery.
* No claims for non-delivery of your complete order will be allowed unless ChocoPatiss is advised within 5
working days from the expected date of delivery.
* Customer Error: If a customer makes an error in placing an order, which causes incorrect or duplicate
shipments, ChocoPatiss may allow, at its absolute discretion, return of the excess merchandise with a 35%
handling charge. This will be adjusted by means of a partial refund once the undamaged goods (“All items
must be returned with reasonable care in their original packaging, in new and unused condition. For
products that are provided with a hygiene seal, the return will only be accepted if the seal is intact”) have
been received. The customer must pay all return delivery charges; ChocoPatiss will not arrange collection.
* No purported variation of these conditions will be valid or binding on ChocoPatiss, unless given in writing
and signed by a duly authorised ChocoPatiss representative.
* The laws of The Netherlands govern all purchases made via this website.
* Dutch VAT will be charged at the rate in force on the invoice date.
* If you are purchasing for a business in Europe, please supply your VAT / Company Registration number at
the time of ordering.
At ChocoPatiss we dispatch Monday to Friday, orders placed before 12pm are presented to our courier at the same day. Any orders placed after 12pm will be presented to our courier on the next working day.
Whilst every effort is made to deliver orders within our estimated time frames please be aware that delays may occur, on occasion, due to unforeseen factors. ChocoPatiss will not be held liable/responsible for delays to deliveries outside of our control, I.E. traffic or weather constraints, 3rd party delays or strike action.
RETURNS PROCEDURE AND POLICY
The return procedure must be initiated within 5 days of receipt of the item (carried out via email or letter). All items must be returned with reasonable care in their original packaging, in new and unused condition, to the address below. For products that are provided with a hygiene seal, the return will only be accepted if the seal is intact. Please include a copy of your invoice or a document stating your name, full address and post code, order number and reason for return. Items should be returned within 7 days of contact. Please ensure you obtain proof of postage at the time of sending; If your item is lost in transit we would not be able to refund without evidence of your proof of postage.
Receipt of returned item and refund
On receipt and inspection of the item/s we will then issue a refund where applicable. You, the buyer, are responsible for covering all return postage costs and we, the seller, do not refund original postage costs for unwanted / incorrectly ordered items. ChocoPatiss will charge € 2,50 administration fee per return delivery, this fee will be deducted from the refund.
We do not accept returns on perishable and consumable goods (I.E. food items), tailor made, special order items or personalised goods.

THE RECIPIENT’S RESPONSIBILITIES.
Placing an Order.
It is the responsibility of the customer to provide a full and correct address and contact details. We will not be liable for any delivery errors arising from an incorrectly information. See non-receipt of orders below.
If delivery is attempted but unsuccessful it is the responsibility of the recipient to contact the delivery company, to arrange re-delivery or collection.
Upon Receipt of Goods.
Upon receiving your order we ask that you check its contents and report any discrepancies found (if any) within 24 hours. If any signs of damage to the box are evident upon delivery, please check the contents before signing. If the goods look affected do not sign for the order, it will be returned to ourselves and we will issue a new order. In cases of damaged good or missing items we will require detailed explanation and photographs to allow us to investigate with our packing team and couriers.
Changes & Cancellations.
As shipments are dispatched via collection, changes and cancellations to an order cannot be accepted once the order is with our packing and dispatch team.
Non-Receipt of Orders.
Please inform us of non-delivery of your order within 5 working days from the expected date of delivery, this allows ample, reasonable time to check with couriers whether your parcel is being held, tracking information can be provided and re-delivery or collection can be arranged. No claims for non-delivery of your complete order will be allowed unless the company is advised within 14 days from the order date.
In the event of:
* Packages delayed / returned due to non-collection or arrangement of re-delivery;
Our couriers’ agents will inform you, if no signatory is present to receive the delivery. It is your responsibility to get in contact with the delivery company to arrange a re-delivery, or collect the parcel.
* Packages returned due to incorrect address supplied;
The customer is responsible for supplying the full and correct shipping address, orders will be sent to addresses as supplied.
You will be liable for the cost of us re-sending the goods if the parcel is returned to us marked as ‘Not called for’ or is due to incorrect or insufficient address details. Failure to comply with these charges will result in the order being cancelled and refunded; original postage costs will not be returned. Parcels will only be resent once the charges have been met.
* Customs charges not paid.
It is the responsibility of the customer to be aware of and to pay any customs charges due to receive the parcel in another country.
You will be liable for the cost of any charges incurred by the courier to ChocoPatiss for a returned package, including shipping and fines; original postage costs will not be returned. You will be liable for the cost of us re-sending the goods if the parcel is returned to us. Failure to comply with these charges will result in the order being cancelled and refunded. Parcels will only be resent once the charges have been met.
Guarantee: ChocoPatiss gives a 1-year guarantee on material- and production errors on the products it supplies.
Prices are always ex-works (exclusive shipping charges), unless otherwise stated.
